Minutes of the Zoning Board of Adjustment Hearing
March 16, 2004
Re:Larry Hartlen’s garage.
Members Present: George Mahnke, Harold Davis, Albion Lyons, Lawrence Kelsea, and Frances Sytek.
Others Present: Larry Hartlen, Adam Kulesza, and Nicole Hartlen
George Mahnke brought the meeting to order.
Larry gave the board a letter from Simone and Derwood McKeage saying that it was okay for Larry to have his garage.
George went over the worksheet that he filled out at the first meeting with the board and explained the facts and questions that he wrote down and why.
-Moving the road.
-Larry could have put the garage back more, because he had enough land.
-Abutter Simone McKeage said “why didn’t Larry follow the law?”
-Mr. Kulesza said it was a hazard with people parking on the side of the road.
-Larry built because he didn’t want to wait for a permit and go through the process.
Mr. Kulesza then said that there is drainage every Spring and it would run onto his property. So moving the road wouldn’t be smart.
George explained to Larry that his building did not meet the Zoning Ordinances by law. Larry said the town shouldn’t have any business in this, they don’t own the road.
George said the shape of Larry’s property could make it so that he could have built the garage the right way. Larry said he could move the telephone pole because it is on his land. Mr. Kulesza jumped in and said that he owned the telephone pole and that he should not be able to move the pole. Mr. Kulesza also stated that Simone McKeage had to get a building permit when she built her shed, so why didn’t Larry? Why doesn’t Larry have to follow the law?
Mr. Kulesza then brought up the issue of the 50ft right-of-way and George explained that we are not discussing that, we are here to vote on a variance, and as Mr. Rappaport explained in the last meeting, that is a civil issue.
Harold Davis made a motion to deny the variance, Frances seconded it, full board approval. Variance denied.
George explained to Larry that some buildings were grandfathered in when the zoning ordinances were first put into place. But that was a long time ago.
Frances made a motion to pass using the new ZBA forms, Lawrence seconded it, motion passed.
Meeting adjourned at 7:00pm
