February 2, 2010 Planning Board Minutes


Chairman Kevin McKinnon opened the meeting at 7 pm.  Board members present were Danny Lyons, Sandra Riendeau, John Jolles and Mike Ouellet.

Others present were Monda Placey, Jason Hodgman, Andy Hicks, David Brooks, Phil Lambert, Dana Masson, Chuck Baldwin and Sheila Beauchemin.


Sign Permit:

Colebrook Area Head Start – 2' x 3' sign to be placed against the porch beam currently existing on the residence at 53 Park Street.  The sign will hang parallel to Park Street and will read, "Caution – Watch for Children.  Drive slowly entering and leaving". John Jolles made a motion to approve the sign application; Sandra Riendeau seconded and all present agreed.  #2010-01

C.N. Brown Co. – 3' x 8' illuminated sign on the roof of the building located at 12 Brandy Lee Lane.  The application noted that the sign would be illuminated with fluorescent lights; however, the Board questioned whether the light would be on 24-hours a day and whether it would be offensive to the residents in the near-by trailer.  A motion made by John Jolles to approve the permit failed due to lack of a second.  Sheila was instructed to contact CN Brown and ask them, or a representative, to come before the Board meeting in March to answer some of the questions.


Waiver of Site Plan Regulations:

Monda Placey - Request for a waiver of site plan regulations for the use of the property located at 38 Colby Street.  Ms. Placey proposed to place a clothing consignment shop within the existing garage and use one room within the residence for computer repairs.  Her grounds for a waiver were she felt the remodeling to accomplish this would not have a negative impact on the area.  Monda also stated she did not believe parking would be a problem as there was room for five vehicles to park in her driveway.  Jason Hodgman agreed, stating they would be parking their personal vehicles out back of the residence. This new endeavor will carry children's clothing primarily, with a possibility of antique furniture or items occasionally.  Sandra Riendeau made a motion to approve the waiver; Mike Ouellet seconded and all present agreed.  Ms. Placey was advised that, should there be a problem regarding this site in the future, the Planning Board had the right to ask for a full site plan review and public hearing.  APPROVED

P.A. Hicks & Sons - Request for a waiver of site plan regulations for the use of the property located at 9 Merrill Street.  Mr. Hicks proposed to enlarge the existing lumberyard via the boundary line adjustment approved earlier in this meeting.  The additional area will be used to store lumber and snow.   Mike Ouellet made a motion to approve the waiver, on condition of ownership of the property in question and payment of site plan waiver fee.  John Jolles seconded and all present agreed.  Mr. Hicks was advised that, should there be a problem regarding this site in the future, the Planning Board had the right to ask for a full site plan review and public hearing.  APPROVED


Subdivision Public Hearing:

Phil Lambert, Jr. – Chairman McKinnon read the application for the proposed subdivision of Mr. Lambert’s property bordered by Titus Hill Road and Skyline Drive (246-21).  The proposed subdivision would create three lots equaling 24.54 acres, 11.48 acres and 20.74 acres respectively.   Included with the application was a waiver request of the requirement to show soil types and soil type lines due to the fact test pit data is provided.  A waiver from the requirement that the plan be at a scale of no less than one inch equals 100 feet was also requested because it was felt the information was at sufficient clarity with the scale of one inch equaling 200 feet.  Topography indication was also requested to be waived due to the time and expense involved.

Mike Ouellet made a motion, seconded by John Jolles, to accept the waivers as presented.  After review of the plan, Mike Ouellet made a motion to accept the subdivision plan as presented.  John Jolles seconded and all present agreed.  #676


Boundary-Line Adjustment Public Hearing:

P.A. Hicks & Sons / James Barba – This boundary-line adjustment between the properties owned by the above parties, located at 9 Merrill Street and 45 & 47 Park Street was originally reviewed at the January 5, 2010 meeting.  At that time, it was found that the lots at 45 and 47 Park Street did not have enough road frontage to meet today's regulations, but were considered "lots of record" and, as such, did not have to comply with the current Zoning Ordinance regulations.  The boundary-line adjustment, however, would create new lots that must meet today's zoning regulations, even though the road frontage did not change.

Mr. Barba appealed the decision to the Zoning Board of Adjustment.  A public hearing was held on January 25, 2010 and the Board of Adjustment granted a variance to Article 4, Section 1  of the Zoning Ordinance which requires 150' road frontage.  The approved variance was subject to the following conditions:  (1)  Trees will be planted on the Barba property of 45 Park Street; (2) a stockade fence to be placed on the boundary line at a 90-degree angle of the PA Hicks property, along with trees if possible.

Andy Hicks, representing PA Hicks and Sons, stated his concern regarding the conditions set by the ZBA.  He questioned the benefit to putting up a fence.  Board member Mike Ouellet wondered if the Zoning Board of Adjustment could add conditions for a fence when they did not issue the permit.  He furthered questioned if the Planning Board should agree to the variance but remove the conditions.

John Jolles questioned the reason the ZBA had added the condition for a fence and trees.  Dana Masson, who had attended the ZBA meeting, felt it was in answer to "no diminution of value of surrounding properties will be suffered".  A quick review of the Office of State Planning website indicated that the ZBA may grant reasonable conditions to the granting of a variance.

Further review of the plan presented indicated that the fence as proposed by the ZBA would, in fact, be placed on an abutter's property other than PA Hicks or James Barba's.  The Board suggested this abutter be consulted prior to applying for a building permit for the fence.

Mike Ouellet made a motion to accept the Zoning Board of Adjustment variance as presented and to approve the boundary line adjustment with said variance.  Danny Lyons seconded and all present agreed.  #677


Bills:

John Jolles made a motion to pay the invoice received from the News & Sentinel in the amount of $46.  Mike Ouellet seconded and all present agreed.


Other Business:

An inquiry was received from a sign company questioning if it was necessary to get sign applications to mount two-inch square signs to the gas pumps at Lemieux Garage, advertising specials.  The Board felt more information was needed and suggested the company prepare the applications and appear before the Board.

James Jeffers – Kevin McKinnon explained that he had spoken to James Jeffers in regards to the certificates of occupancy for his modular homes recently placed on Carlton Hill, informing him that he needed the names of the contractors for the electricity and plumbing.  It was explained that the homes are built in a hugh factory and it is not known who completed the wiring.  The plumber's NH Master's License number is indicated on the form and a statement indicates that a NH Licensed electrician from E.W. Electric had performed the electrical installation.  It was agreed that the certificate of occupancy could be signed by the Planning Board, inspection waived.

It was noted that the new basket weaving business endeavor which has set up shop over Hicks Hardware has not applied for a site plan waiver.  Sheila was asked to send them a letter and a site plan waiver form.

Mike Ouellet made a motion to accept the minutes of January 5, 2010 as written.  Sandra Riendeau seconded and all present approved.

The meeting was adjourned at 9 pm.
