Planning Board Minutes
October 2, 2006
Chairman Mike Ouellet opened the meeting at 7:15 pm. Board members present were PersonNameKevin McKinnon, Edward Carrier, Selectman Benoit Lamontagne and alternate Joe Ippolito. Joe was asked to sit in for Irene Bean.
Others present were Roland Cotnoir, Mark Santangelo and son, Claire Lynch, Sandra Dodge and Robert Hodge.
Driveway Permit:
Dawn P. Kelsey – Construct a driveway access road entrance to her property located on addressStreetReed Road (R11 Lot 96). Public Works Director PersonNameKevin McKinnon pointed out he was aware that the septic system belonging to the neighbor across the road is situated on the above property. Before he could approve placement of a driveway access, it would be necessary to know where the system and leach field are located in relationship to where the proposed driveway would be placed. Ms. Kelsey will be advised of this fact and asked to submit a sketch that can be attached to the driveway application. Until this information is received, the Board is unable to act upon the application. TABLED
Building Permits:
Shawn Keezer – 8’ x 10’ enclosed porch on the front of his home at addressStreet174 East Colebrook Road (R10 Lot 65). Edward Carrier made a motion to approve the permit; PersonNameKevin McKinnon seconded and all present agreed. APPROVED - #2006-83
Michael Konosky – Extend Permit #2004-88 to build a four-bedroom vacation home on his property on addressStreetRussell Road. Upon review, the Board realized that two years had elapsed since the original permit was issued; therefore, any construction now might not meet today’s regulations. PersonNameKevin McKinnon made a motion that Mr. Konosky must reapply for a building permit, indicating the present progress on the building, along with a proposed completion date. Benoit Lamontagne seconded the motion and all present agreed. EXTENSION DENIED
As a result of the discussion that ensued over whether to grant a second extension, it was determined that a form should be created that needs to be filled in when an extension is asked for, rather than just a letter from the owners. This form would ask what the present progress is on the building and the proposed completion date.
Scott Bourque – Extend Permit #2005-61 to build a 36’ x 56’ three-bedroom vacation home on his property on addressStreetRussell Road. PersonNameKevin McKinnon made a motion to extend the permit for one year, until July 2007, or until a certificate of occupancy is received. Benoit Lamontage seconded the motion and all present agreed. EXTENDED, July 2007
David Hodge – 14’ x 48’ three-sided shed to be placed on his property on 1007 Route 26. PersonNameKevin McKinnon made a motion to approve the permit; Benoit Lamontagne seconded and all present agreed. APPROVED - #2006-84
Elizabeth Bascom – 12’ x 12’deck on back of home located at addressStreet304 Diamond Pond Road. PersonNameKevin McKinnon made a motion to approve the permit; Joe Ippolito seconded and all present agreed. APPROVED - #2006-85
Gary & Mary Jo Bergeron – Place a camper on their lot on addressStreetAtwood Drive (R9 Lot 116) for winter storage and then use it as a seasonal camp for approximately May through October. It was noted that an incinolet toilet would be utilized. A notation in the deed attached noted a covenant that “no trailers or mobile homes shall be placed upon conveyed parcel as a residence unless approved in writing by the grantors.” The application, in all other respects, met the Colebrook Zoning Ordinances; however, the Board was uncertain as to whether the application could be approved since they were now aware of the covenant. PersonNameKevin McKinnon made a motion, seconded by Joe Ippolito, to table the application until legal counsel had been obtained. The vote was three in favor and
one nay (E Carrier). TABLED
Susan Nash – Add on to existing garage, 30’ x 60’, located at addressStreet129 Hughes Road (R6 Lot 52). It was noted that no water or septic would be utilized in the structure. PersonNameKevin McKinnon made a motion to approve the permit; Benoit Lamontagne seconded and all present agreed. APPROVED - #2006-86
Subdivision Public Hearing (continued):
Robert Hodge – Chairman Ouellet recapped that Mr. Hodge was proposing a two-lot subdivision of his property located off addressStreetCotnoir Drive, identified on the Colebrook Tax Maps as R10 Lot 6. Action on the subdivision had been tabled until the right-of-way issue brought before the Board by Robert Delong was clarified. Mr. Delong was asked to bring information regarding his position to this November meeting. Chairman Ouellet noted that Mr. Delong was not present.
The proposed plan indicates two lots to be serviced off addressStreetCotnoir Drive. Once again, Mr. Hodge was reminded that if the remaining property was further subdivided and access was necessary off addressStreetCotnoir Drive, the road would need to be brought up to town specifications before a subdivision could be approved.
Joe Ippolito made a motion to approve the subdivision plan as presented; Benoit Lamontagne seconded and all present agreed. #639
New Business:
Town of CityColebrook – Lynnfield Engineering has submitted on behalf of the Town of placeCityColebrook an Amended Excvation Permit Application for Phil Lambert’s proeprty on Titus Hill. It was questioned whether a full public hearing must be conducted for an amended application. PersonNameKevin McKinnon stated the Town of placeCityColebrook Excavation Regulations indicate an applicant will apply for an amendment if the original permit cannot be maintained. He remarked that the original excavation plan and reclamation plan will stay in affect. A review of the RSA’s governing excavation appeared to require a public hearing if the size is altered. It was decided to warn a public hearing for November 6, 2006.
Old Business:
placeCityChester Grover – Mr. Grover had received a letter last month regarding several vehicles located on his property on addressStreetBungy Road which did not appear to be registered or no longer intended or in a condition for legal use. He came in just prior to the meeting and stated that he had only two unregistered vehicles. The other three are legally registered and road worthy.
It was noted that Michael Bouchard had completed his building addition. It was also noted that the abutter’s well to the James Alton property on addressStreetReed Road had been sampled for e-coli and none had been found. Legal counsel will be obtained as to whether a fence used for agricultural purposes is exempt from the zoning ordinance requiring a permit for any fence four feet or higher.
The Board concluded it would be beneficial to revise the site plan regulations to include a time limit on projects and to expand site plan review to include a “change of use” even where no development occurs. It was also noted that a time limit for building permits is not stated in the Zoning Ordinance, but only on the permit itself. It was agreed that this should be amended in the Zoning Ordinance. The amendments to the Floodplain Ordinance suggested by the Assistant State Coordinator for the National Flood Insurance Program included a definition for manufactured home park. In reviewing this, it was realized manufactured (mobile) home parks are not defined in the Town of placeCityColebrook’s Zoning Ordinance. Legal counsel will be asked to help with the correct wording prior to setting up public
hearings.
The minutes of the August 21st meeting could not be approved due to the fact that a quorum of members who were present at the August 21st meeting were not present at this meeting. The minutes for September 11th were approved as written.
