Planning Board Minutes
September 11, 2006
Chairman Mike Ouellet called the meeting to order shortly after 7 pm. Board members present were Irene Bean, Edward Carrier, Selectman Benoit Lamontagne, and alternate Joe Ippolito. Joe was asked to sit in for PersonNameKevin McKinnon.
Others present were Frances Sytek, Bill Sambito, Roland Cotnoir, Ronnie Crawford, Robert Hodge, Robert Delong, Colin Sutherland, Mark Santangelo, Donna Jordan, Claire Knapper and PersonNameSheila Beauchemin.
Public Hearing:
Rules of Procedure – After short deliberation, Irene Bean made a motion to approve the Rules of Procedure as presented. Joe Ippolito seconded and all present agreed.
Building Permits:
Mark Santangelo – 29’ camper trailer to be placed on the property currently owned by Robert Hodge, off Cotnoir Road (R10 Lot 6). Mr. Santangelo indicated the camper will be occupied from September to November while his home is under construction and then it would be put in storage. This permit was denied last month as the waiver for a septic design was not completed. Mr. Santangelo stated that the black water tank was being dumped at Coleman State Park once a week and produced receipts. Edward Carrier made a motion to approve the permit; Joe Ippolito seconded and all present agreed. APPROVED - #2006-80
Irene Bean removed herself from the Board.
Center Hill Barns, LLC – 28’ x 36’ three-bedroom camp to be placed on their property located at 55 Stevens Hill Road (R5 Lot 17). Irene Bean once again questioned the driveway situation for this property, reiterating that she would like to see the driveway moved as she feels its present placement will cause more run-off onto her property. Chairman Ouellet remarked that driveway problems have no bearing on the building permit being presented. Edward Carrier asked if the abutters had been approached regarding the drainage problem, and, if not, perhaps they weren’t even aware of a problem.
Edward Carrier moved that the application for a 28’ x 36’ camp be approved; Joe Ippolito seconded and all present agreed. APPROVED - #2006-81
Center Hill Barns, LLC – 24’ x 28’ storage building to be placed on their property at 55 Stevens Hill Road (R5 Lot 17). Edward Carrier made a motion to approve the permit; Joe Ippolito seconded and all present agreed. APPROVED - #2006-82
Irene Bean resumed her seat on the Board.
Ralph Holmes – Extend permit #2004-84 to build a 24’ x 28’ camp on their property off Blakely Farm Road (R11 Lot 60.) Edward Carrier made a motion to extend the permit for three months, to expire December 2006. Joe Ippolito seconded and all present agreed. EXTENDED TO DECEMBER 2006
Garth & Cassie Hurlbert – Extend permit #2005-88 to build a 10’ x 12’ breezeway and 30’ x 32’ garage on their property off Harvey Swell Road. Edward Carrier made a motion to extend the permit one year, until September 2007. Irene Bean seconded and all present agreed. EXTENDED TO SEPT. 2007
Subdivision Public Hearing:
Robert Hodge – Surveyor Colin Sutherland explained that Mr. Hodge is proposing to create a 34 acre lot. The access would be a right-of-way off from the private road, referred to as Cotnoir Road. Mike Ouellet explained that, should another home be put on the remaining acreage, the private road would have to be brought up to town specifications and/or looped to a Class V road as it would then be servicing three homes. It was determined that Cotnoir Road is approximately one-half mile in length. Mr. Hodge asked, if Cotnoir Road was widened so that two cars could pass each other, would that be sufficient. Edward Carrier stated that the town regulations state a loop road is necessary.
Robert Delong questioned who owned the trailer which has been set near his father’s lot (#50). Mark Santangelo, the buyer for the proposed 34-acre lot stated that the trailer was his. Mr. Delong believes a deeded right-of-way to his father’s land which would cross the newly proposed piece has since been taken out of deeds. It was believed that his father use to travel over the corner of Roland Cotnoir’s land to reach his lot. Mr. Cotnoir stated his deeds do not show any right-of-way. Robert Hodge remarked that no right-of-way is indicated in his deed. Mr. Delong remarked that there was no access to the property off East Colebrook Road as far as he knew. Chairman Ouellet remarked that Mr. Delong needs to research his deeds and, should a right-of-way be there, the problem is
a civil issue. Mr. Sutherland remarked that the deeds give very little information as they were originally written in the 1920’s and refer to parcels only. He did relate that when he walked the newly proposed parcel, he found no roads going in the direction of Mr. Delong’s lot.
Edward Carrier stated that he agreed that the right-of-way was a civil issue; however, the fact that a third lot might be serviced off from Cotnoir Road does create a problem for this subdivision application as it would mean that the creation of this new lot means three lots would be serviced by Cotnoir Road. This would require a loop road now.
Chairman Ouellet then read the subdivision application indicating a two-lot subdivision of Robert Hodge’s property located off Cotnoir Drive, identified on the Colebrook Tax Maps as R10 Lot 6. Irene Bean made a motion to accept the application as read; Benoit Lamontagne seconded and the vote was three ayes and one nay (Ippolito).
A waiver from the land subdivision regulations requiring soil contours was requested. The reason for the waiver request was the fact that this is a minor subdivision with only one large lot of 33 acres being separated and it would require much time and effort to provide accurate contours. Edward Carrier made a motion to accept the waiver; Benoit Lamontagne seconded and all present agreed.
Joe Ippolito then made a motion to table the approval or non-approval of the subdivision plan until the right-of-way issue is cleared up. Edward Carrier seconded and all present agreed. It was agreed that Mr. Delong needs to bring proof of a right-of-way to the next meeting. It was agreed that if the deeds do not show a right-of-way, it becomes a civil issue and does not affect the issue at hand. TABLED
Excavation Permit Application:
Robert Hodge – Mr. Hodge had originally filed an excavation application to review and approve excavation on his property located off Route 26, identified on the Colebrook Tax Maps as R10 Lot 6. Since that time, he has discovered that the costs involved in opening up a gravel pit on his property would be too costly, therefore, he asked to withdraw his application.
Conceptual Boundary-Line Adjustment:
Bradley Montague / Ronnie Crawford - Ronnie Crawford presented a conceptual design for a boundary line adjustment between his property and Mr. Montague’s. The lot line adjustment would add two acres, including a pond, to Mr. Crawford’s property. Mr. Crawford was concerned regarding the pond and was advised that the pond should not be an issue. No problems were noted.
Conceptual Site Plan:
William Sambito approached the Board with a conceptual design for the North Country Community Recreation Center’s plan for the area outside the swimming pool building. The proposed plan showed a covered pavilion skating rink, along with a skateboard park, playground, etc. Chairman Ouellet advised Mr. Sambito that a public site plan review would be necessary. At that review, specifics on outdoor lighting plans, drainage on and off the property, snow removal and storage, and other items would be reviewed. Mr. Sambito was given a copy of the site plan checklist for his assistance. Mr. Ouellet also remarked that it might be helpful to have the snowmobile trail indicated on the plan.
Mr. Sambito was also reminded that building permits would be necessary for any additional structures to be added to the area.
Bills:
Benoit Lamontagne made a motion to approve the invoice from the News & Sentinel for $121.00. Irene Bean seconded and all present agreed.
New Business:
Frances Sytek approached the Board regarding the delivery trucks which run all night while parked on the property owned by PA Hicks in Sons abutting her property. She remarked that the previous evening a delivery truck arrived at 8:20 pm and ran until 11:20 when she called radio dispatch and a police officer went over to have the truck shut off. Two hours later, the truck started again and ran until 5:30. She felt that, if skidoos have a curfew from 10 pm to 7 am, large trucks should also. It was questioned if a nuisance law was in existence.
Mrs. Sytek asked why the Board had placed no restrictions regarding trucks running all night when this site was reviewed for expansion. Mr. Ouellet remarked that the Planning Board reviewed a building permit only for that property, no site plan. Mrs. Sytek commented that she felt that Board should have contemplated what the addition of that building would mean later. Mr. Ouellet stated that the only recourse now is the police and/or the selectmen for a noise or nuisance ordinance. She was advised to be sure to call radio dispatch whenever there is a problem and have every call entered into the log.
Mark Santangelo asked if a building permit was necessary for a windmill. The general concensus of the Board was that a permit was not necessary.
Chester Grover – The Board was made aware of a possible violation of the Colebrook Zoning Ordinances at the residence of Chester Grover on Bungy Road. There appears to be several vehicles located on his property which appear neither to be registered or in a condition for legal use. A letter will be sent asking him to attend the October meeting.
A letter from Guy LaPerle and Marc Bigney referring to unpaid taxes being paid prior to granting a building permit was reviewed.
Old Business:
Benoit Lamontagne made a motion, seconded by Edward Carrier, to approve the August 7th meeting minutes as presented.
