Colebrook Planning Board Minutes
December 14, 2004
Chairman Mike Ouellet called the meeting to order shortly after 7 pm. Board members present were Kevin McKinnon, Edward Carrier, Sandra Riendeau, Selectman Frank Dumaine and alternate John Jolles.
Others present were Claire Lynch, Donna Jordan, Ken Curry, Jon Cowan, David Brunault, Carrie Klebe and Sheila Beauchemin
Driveway Permit:
Colburn Associates, Inc. – Access to their property bordered by Route 26 and Hasen Drive (R10 Lot 14). This parcel, identified as Parcel C, on the subdivision #621, is indicated as a non-buildable lot. It was felt by Board members that a driveway access should still be obtained. The Public Works Director indicated that an access off Hasen Drive would be acceptable with the inclusion of a 20 foot culvert, minimum 12” plastic or 15” steel. Sandra Riendeau made a motion to approve the permit; Edward Carrier seconded and all present agreed. APPROVED - #2004-140
Building Permit:
Kenneth Curry, Jr – 30’ x 40’ home with three-bedrooms to be located on Bennett Hill Road (R4 Lot 32). A letter from septic designer Leo McKinnon indicated the test pit data had been completed and the land would support a four-bedroom home with well. The driveway access had been approved with the subdivision for the parcel. Kevin McKinnon made a motion to approve the permit, conditional on receiving the approval for construction of the septic system from DES; Sandra Riendeau seconded and all present agreed. Sign Permit:
David Brunault – Mr. Brunault indicated that he had received permission in January 2001 to place a 5’ x 6’ sign on the building lot behind Northwoods Trading Post, stating “Commercial Lot for Sale.” He stated he had never put the sign up and now needs to place a 4’ x 6’ sign on his storage warehouse building, stating “North Country Self Storage”. He questioned if he could substitute one for the other. It was noted that the current request is for a different sign than the original permit. Edward Carrier made a motion to approve the amendment of Permit #2001-02, with fee waived, as long as a new permit was filled out with a picture of the new sign attached. Kevin McKinnon seconded the motion and all present agreed. AMENDED
In regards to a sign to be placed on the property currently owned by Mike Robinson, Mr. Brunault was advised to bring in a copy of the deed stating he has the right to place a sign on that property. Mr. Brunault indicated that there was a common sign area which would be used by three businesses. John Jolles questioned if this would defeat the original intent of the sign regulations.
Subdivision Public Hearing:
Colburn Associates, Inc. – Chairman Ouellet read the new subdivision application, indicating subdivision approval being sought for Colburn Associates for parcel B (R10 Lot 59) and Parcel C (R10 Lot 14), located on Route 26. It was noted that parcel B had received NH DES Subdivision approval; however, none was necessary for Parcel C because it was indicated as a non-building lot, completely within the floodplain. A variance request was requested for showing soils types and soil type lines. Edward Carrier made a motion to accept the subdivision application as presented, along with the variances. Kevin McKinnon seconded and all present agreed.
It should be noted that this subdivision application replaces the one submitted October 14, 2004, advertised as seeking approval for Parcel B only. As the November minutes indicate, a subdivision approved in 1986 only approved Parcel A, leaving Parcel B and Parcel C unable to obtain title insurance. It has become necessary to recognize Parcel B and Parcel C as separate lots for this reason. A new application was submitted for both parcels, and the abutters were notified a second time.
Mr. Cowan noted that the two lots are separated by Route 26 and that Parcel C is a stand-alone lot, not to be considered a building lot. Currently there is one deed for lot B and C, noting two separate parcels. Mr. Cowan explained that it was conceivable that the lots could be sold separately to different people; however, the intent is to sell the two together. The two lots are taxed as separate lots; and two separate descriptions for the lots have been written by Mr. Cowan. Edward Carrier remarked that there is no driveway access onto Parcel C, and even though it is to be considered a non-buildable lot, he felt one needed to be approved and indicated on the plan.
Edward Carrier made a motion to approve the subdivision, conditional on receiving a driveway permit for Parcel C. Kevin McKinnon seconded and all present agreed. A driveway application was presented for approval for an access off Hasen Drive. (see above) #621
David Brunault (continued): Mr. Brunault explained that his fifteen-lot subdivision of his property located off Ramsay Drive has been put on hold until spring. At present, timber is being cut.
Conceptual Design:
Dana Nordberg - Surveyor Jon Cowan showed the Board a conceptual design of a three-lot subdivision of Dana Nordberg’s property located on Diamond Pond Road, identified as R2 Lot 4-2. Edward Carrier questioned if a cul-de-sac was necessary as the existing right-of-way would now be servicing more than three lots and it was agreed one would be necessary. Mr. Cowan will bring in the application and abutters list so that the hearing can be warned for January 2005.
Bills:
Kevin McKinnon made a motion to approve payment of the invoice from Gardner, Fulton and Waugh totaling $1,119.58. Edward Carrier seconded and all present agreed.
Old Business:
A letter from Victor and Aimee Poulin was read in regards to the various items noticed in the field behind the Wayne and Paula Chapple residence on Route 26. They explained that the old refrigerators were used to play paintball and that they had no intention of beginning a potential business refurbishing the items.
Chairman Ouellet’s memo regarding the walk-through inspection of Marie Josee Vaillant’s garage in question at last month meeting was read. Mr. Ouellet stated he found three rooms within the building, being used for storage only, with no on-going activities within the building. He explained to Ms. Vaillant that, if the use of the building should change from personal storage, she would have to come back before the Board.
New Business:
Land Recording (Tax Map R7A, Lots 1, 2 & 3) Carrie Klebe of Ray Davis Realty approached the Board regarding a problem with the property located partially in Colebrook and partially in Columbia, identified on the Colebrook Tax Maps as R7A, Lot 1, 2 & 3. Access to this property is via a right-of-way located in Columbia. A map located at the Columbia offices indicated that the Columbia Planning Board reviewed and signed a plan for these lots on June 25, 1979. The only reference to these parcels in the Colebrook records was found in the July 10th, 1979 Planning Board minutes, under “Old Business” – “Shaw filed with us, a copy of the lots he proposes selling on the Columbia town line. Recorded before subdivision was effective in town.”
A title search at the Registry did not find a subdivision plan for these lots. To facilitate a potential sale, Mrs. Klebe asked if it was possible for the Colebrook Planning Board to sign off on these three lots as “equitable waiver of dimension”. Edward Carrier made a motion that the Board send the material from Mrs. Klebe to the town attorney to see if this is an adviseable course of action. At the same time, it will be asked if the right-of-way to the properties and the name of abbuter whose land this right-of-way crosses needed to be indicated on the plan per today’s standards. Mrs. Klebe will be made aware that any legal expense will not be the burden of the Planning Board or Town, but would be billed to the applicant. Frank Dumaine seconded the motion and all present
agreed.
The Board reviewed the budget figures for the following year, indicating few changes. Various questions regarding extension of permits, whether three or four mobile homes on the same parcel of land would come under cluster regulations; right-of-way issues; whether agriculturual endeavors come under the site plan regulations and when a yard sale becomes a commercial endeavor were discussed.
