Colebrook Planning Board Minutes
June 8, 2004
Vice Chairman Edward Carrier called the meeting to order shortly after 7 pm. Board members present were Kevin McKinnon, alternates Sandra Riendeau, Joe Ippolito and John Jolles. Sandra was asked to sit in for Mike Ouellet and John was asked to sit in for Steve Garceau.
Others present were Charles O. Stevens, Steve McCormack, Alessandra Nunes, Marie Josee Vaillant, Sheila Parkhurst, Beth St. Onge, Larry Rappaport, Donna Jordan, Mike Bouchard, Lucie Fillion, Robert Shaw, David Brunault and Sheila Beauchemin.
Sandra Riendeau removed herself from the Board.
Driveway Permit:
Gaston Riendeau - Access to property off Piper Hill Road (R6 Lot 45). Public Works Director Kevin McKinnon had viewed the site and indicated that he found no problem with the line of sight. He did indicate that a 15" culvert would be necessary. John Jolles made a motion to approve the permit with the public works director's recommendations; Kevin McKinnon seconded and all present agreed. APPROVED - #2004-46
Sandra Riendeau resumed her seat on the Board.
Building Permits:
River of Life Worship Center - 30' x 70' temporary tent from July 16 to July 31 to be set in the field across from the Fish Hatchery Road on Route 26. Bruce Holt had written a letter of approval and the Department of Transporation had approved the temporary drivewy permit. Mr. Stevens indicated there would be a temporary toilet facility on site during the two weeks. Sandra Riendeau made a motion to approve the permit and waive the fee; Kevin McKinnon seconded and all present agreed. APPROVED - #2004-47
Stephen J. McCormack - 12' x 55' mobile home with screened in porch to be placed on his property located on Diamond Pond Road (R2 Lot 9). Mr. A letter from Jim Wells indicated that a state approved septic design had been completed and test pits indicated the lot would support both a septic and water. Kevin McKinnon made a motion that the permit be approved, conditional on receiving a state approval septic design from DES. Sandra Riendeau seconded and all present agreed. CONDITIONAL APPROVAL - #2004-48
Sheila Parkhurst - 8' x 12' storage shed on her property on Route 3 North (U1 Lot 2). Sheila also indicated that she would not be completing the residence on this lot that she had applied for in April. Kevin McKinnon made a motion to approve the permit; Sandra Riendeau seconded and all present agreed. APPROVED - #2004-49
Alessandra Nunes - Six-foot fence surrounding her back yard at 14 Lombard Street (U8 Lot 44). Kevin McKinnon made a motion to approve the permit; Sandra Riendeau seconded and all present agreed. APPROVED - #2004-50
Marie Josee Vaillant - 30' x 36' garage with a two-bedroom apartment to be attached to her residence on Aldrich Road (R2 Lot 2). Ms. Vailliant indicated that a new septic had been installed which approved for six bedrooms. There are currently four bedrooms in the house. Sandra Riendeau made a motion to approve the permit; Kevin McKinnon seconded and all present agreed. APPROVED - #2004-51
After the approval, Robert Shaw stated that he had an objection. He indicated that the Board had just approved a building permit next to him and had asked nothing about the road. He felt there was a problem with adequate access and was upset that the Board had approved the permit without discussing the access issue. He further explained that he did not wish to go through mud again as he had to this year. He felt there was a safety issue that should be considered as the present road is not made for the amount of travel that occurs because of Marie Josee Vaillant's residence. He stated that, if the Town was willing to spend $300,000 to fix the road, he would have no problem. He had never had a problem before and felt the reason for it now was the increased traffic. He insisted that the rest of the
road needs to be fixed - with the rocks needing to be covered. He stated he believed there was too much traffic on the road and that the people living at Ms. Vaillant's should not go out on Aldrich Road but should use the old Town Line Road instead. He questioned, again, how the Board could approve this permit without considering the road.
Kevin McKinnon responded that he felt Ms. Vaillant had a right to build on her property. He also remarked that Aldrich Road is a Class V road and can be traveled by Mr. Shaw or anyone else. Access cannot be stopped. He advised Mr. Shaw that his concerns regarding the road were a Selectman's issue.
Mr. Shaw remarked that he understood that the road was being surveyed by Jon Cowan and he wished a certified copy be sent to him and the Secretary of State. He further advised that Board that their decision could end of with a jury trial.
Edward Carrier advised a stunned Marie Josee Vaillant that the road issue was between Bob Shaw and the Town of Colebrook and she could continue with requested building.
Mike Bouchard - 138' retaining wall of concrete blocks at 172 Main Street (U12 Lot 7). It was noted that a right-of-way easement exists for the water line. Sandra Riendeau made a motion to approve the permit; Kevin McKinnon seconded and all present agreed. APPROVED - #2004-52
Derwood & Simone McKeage - 10' x 20' deck on side of home with 3' x 3' porch at Hartlen Avenue (R9 Lot 121). Kevin McKinnon made a motion to approve the permit; Sandra Riendeau seconded and all present agreed. APPROVED - #2004-53
Lawton P. Bourn - 24' x 30' two-bedroom log home and adjoining garage on his property on Reed Road (R10 Lot 96A). Sandra Riendeau made a motion to approve the permit; Kevin McKinnon seconded and all present agreed. APPROVED - #2004-54
Marc & Sandra Simmler - 14' x 16' breezeway and 24' x 32' garage with one-bedroom second floor attached to his residence on Russell Road (R12 Lot 73). It was noted that this request took the place of the permit in August 2003 which was tabled due to indicate septic facilities. Since that time, an amended septic design has been approved by the State of New Hampshire. Kevin McKinnon made a motion to approve the permit; Sandra Riendeau seconded and all present agreed. APPROVED - #2004-55
Rick and Nancy Hersey - 22' x 28' cottage to be placed on their property off Fish Hatchery Road (R9 Lot 52). As there was no indication of septic facilities, Kevin McKinnon made a motion to table the permit until further information was received; Sandra Riendeau seconded and all present agreed. TABLED
Matthew Goudreau - Enclose current 10' x 10' deck on his mobile home situated in Boudle's Trailer Park, lot 40. Agreement for the addition was indicated by Clifton Boudle. Kevin McKinnon made a motion to approve the permit; Sandra Riendeau seconded and all present agreed. APPROVED - #2004-56
Kim & Adam Ori - 15' x 21' deck to be placed on their residence at 21 Parsons Street (U13 Lot 44). The left property line setback was indicated as six (6) feet. As the breezeway would be in line with the existing house, the Board had no problem however; the Zoning Ordinances for the Town of Colebrook state that every structure placed on a lot shall be at least ten (10) feet from the side and rear property lines; therefore, the Planning Board had no option but to deny the permit. Kevin McKinnon made a motion to deny the permit; Sandra Riendeau seconded and all present agreed. Mr. & Mrs. Ori will be advised that they may appeal the Zoning Board of Adjustment for a variance. DENIED
Sign Permit:
River of Life Worship Center - 4' x 8' illuminated sign to be placed in the field across from the Fish Hatchery Road entrance. Mr. Stevens explained that the sign was a portable one and would be in placed from July 16 to July 31st. Kevin McKinnon made a motion to approve the permit and waive the fee; Sandra Riendeau seconded and all present agreed. APPROVED - #2004-57
Boundary-Line Adjustment Public Hearing:
Terrence Hughes – Chairman Ouellet read the boundary line adjustment between the property owned byTerrence Hughes and Kathleen Keazer, located on North Main Street, identified on the Town of Colebrook Tax Map as U3 Lot 8 and U3 Lot 9, respectively. Sandra Riendeau made a motion to accept the application; Kevin McKinnon seconded and all present agreed.
Larry Rappaport explained that, in the process of sales negotiations, Mr. Hughes relayed that there was a possible encroachment problem, as he understood his home had been partially built on Kathleen Keazer’s property. Research of the deed does not indicate this as being the case. Further research is being conducted, but to facilitate matters, they wished to begin the public hearing process so that, next month, they could gain approval for a boundary line adjustment, if necessary.
New Business:
Luci Fillion questioned if a permit had been obtained for the camper located for more than two weeks behind Colebrook Floor Care. Sandra Riendeau volunteered to speak with Frances Sytek.
IN answer to a question regarding whether the purchase of a residential garage to be used for painting and repair, and small mechanical work, of private equipment would require a site plan, the answer was in the affirmative.
Kevin McKinnon raised the question if he should be signing as Secretary of the Planning Board on the driveway permits issued, whereas he reviews the site as Public Works Director for safety. Joe Ippolito and John Jolles stated that they felt it was two different positions and could see no problem.
Bills:
John Jolles made a motion to pay the invoice from Attorney Waugh’s law firm for $1,377.10, along with the invoice from Jordan Associates for 28.50. Kevin McKinnon seconded and all present agreed.
Old Business:
John Jolles made a motion to approve the May minutes, with the corrections noted. Kevin McKinnon seconded and all present agreed.
